(i) About these terms and conditions
11+ Prep School provides (A) services (e.g., tuition), (B) a shop that sells digital and tangible products (e.g., educational materials) and (C) a website (i.e., 11plusprepschool.co.uk). The terms and conditions outlined in this page (https://www.11plusprepschool.co.uk/terms-conditions) are considered to be the definitive version of these terms and conditions. The terms and conditions on this page will overrule any copy of these terms and conditions published elsewhere.
These terms and conditions will address each of these services/products in turn.
(ii) Acceptance of these terms
Your buying a tuition service from us, your buying a product from us, and your use of this website constitute your act of consent to these terms & conditions as well as our privacy policy. If you disagree with any of these terms & conditions, or with any aspect of the privacy policy, you should discontinue your purchase of a product or service from us and/or your use of this website.
(iii)Modification of these terms
We may update these terms at any time without warning or notification.
(iv) Governing Law & jurisdiction
Your use of 11 Plus Prep School's services, products and website is subject to the laws of England & Wales. Any dispute arising from your use of this website shall be subject to the arbitration of the courts of England & Wales.
A1. Services
A1.1 Service Definition
11+ Prep School provides tuition to children preparing to sit an 11+ exam or independent school exam, or to children who need extracurricular tuition. Tuition may either be class-based or one-to-one; lessons may be provides online or on-premise.
By purchasing a tuition service from us you acknowledge and accept that the cost of your purchase is inclusive of lesson preparation, homework preparation & marking, and the lesson itself, as well as any associated administrative labour.
A1.1.2 What the service does not guarantee
The service aims to provide your child an education in some or all of the 11+ subjects: English, mathematics, verbal reasoning and non-verbal reasoning, as well as subjects as and where appropriate (e.g., creative writing).
Our service does not guarantee that your child will pass an 11+ exam nor be deemed selective for any grammar school, or for a specific grammar school.
A2. Tuition Fees and Payment Schedule
A2.1. Tuition fees of courses
The stated cost of our tuition fees can be found on the "courses" page of our website: https://www.11plusprepschool.co.uk/courses.
A2.2 Payment schedule of tuition fees (group tuition)
The schedule of payment shall be half-termly. The half-termly tuition fees must be paid by the date specified in the half-termly invoice that we send to you. We do not offer alternative payment schedules for group tuition.
A2.3 Payment schedule of tuition fees (one-to-one tuition)
The payment schedule for one-to-one tuition is monthly, i.e., if your child's tuition is on Monday and there are five Mondays in the month, you shall be liable for five weeks' of tuition fees.
A2.4 Ongoing invoicing
When 11 Plus Prep School enters a new term or payment cycle, we shall send you an invoice detailing costs and the payment deadline. If payment is not made by the payment deadline, we may - and reserve the right to - levy a surcharge to cover additional administrative costs or unenroll your child and offer their space to a child on our waiting list.
A3. Pre-registration & Registration
A3.1 Pre-registering your child
When you first contact 11 Plus Prep School as a new customer and advise us that you wish to enrol your child onto an 11+ Prep School course, we will pre-register (i.e., provisionally enrol) your child onto the course. For pre-registration purposes, to ensure that we correctly pre-register your child, you agree to provide us with your phone number, your email address, your child's first name and year of study. These are the minimum details we require to successfully register your child. Failure to provide these minimum details
The period of pre-registration lasts until payment has been made for our tuition services.
A3.2 Registering your child
When you advise us that you wish to use our tuition services for group tuition, we shall invoice you by email the half-termly cost of the tuition fees. In the invoice we shall specify a payment due date. The payment due date will be the Sunday before your child's first lesson, or 48 hours before your child's first lesson: whichever length of time is greater.
If payment is not made by the payment due date, you may forfeit your child's pre-registration on the course; in which case your child may be de-registered.
Note that if you fail to inform us of your payment to us, this may result in a delay to the commencement of our tuition services to you.
Your child becomes registered onto our course when you have made payment in full for the invoiced tuition fees, and you have notified us of payment and we have acknowledged receipt of payment; at which point your child's pre-registration period ends.
A3.3 Payment after deregistration
[14th March 2024 update: see A5.1]
A3.4 Onboarding
Once we have successfully registered your child onto a course (i.e., they are enrolled) we shall send you an onboarding email (or emails) with the information you need ahead of your child's first lesson.
A4. Attendance & Punctuality
A4.1 Commitment of attendance
11 Plus Prep School strives to provide children with a stable learning environment, in which the will see the same faces every week. This stability contributes to the child's enjoyment of the lesson and their ability to learn. For this reason, we expect commitment to attendance to every lesson across an entire academic year.
Therefore, by enrolling on an 11 Plus Prep School course, you are committing your child's attendance to every lesson of the course. As with a normal, daytime school, attendance at 11 Plus Prep School is compulsory. When you sign up for an 11 Plus Prep School course, you are acknowledging your commitment to your child's 100% attendance.
A4.1.1 Non-attendance owing to sickness, emergency or for any reasons for compassion
If your child is sick, or if there is an emergency, or should there be reasons for compassion (e.g., bereavement), please inform us as soon as possible that your child cannot attend the lesson giving the reason for non-attendance.
We do not refund fees for any lessons missed owing to sickness, emergency or reasons for compassion, nor do we discount money from future invoices. We may however, offer your child the opportunity to attend equivalent lessons held at another time in the week where this is a possibility.
At our discretion, we may offer to help your child catch up with any missed lesson owing to sickness or reasons for compassion. This may take the form of a one-to-one lesson and we may, at our discretion, offer any catch-up lesson(s) free or charge, for a nominal fee, or for the going one-to-one rate.
A4.1.2 Non-attendance owing to holiday
If your child does not attend a lesson owing to holiday, you agree to notify us of your child's non-attendance at least two week's in advance of your going on holiday. If you go on holiday during a period that you have already paid for, you agree that you forego any claims for reimbursement of money or discount of fees from future invoices. Likewise, if you are on holiday during a period of time that has not yet been invoiced for, you agree that you will pay the full invoice for the term.
In the even that you go on holiday without paying the termly fees, we shall unenroll your child from their 11 Plus Prep School course so that we can offer their place to a child on our waiting list.
If you go on holiday, you accept that 11 Plus Prep School is under no obligation to help your child catch up on missed lessons.
In the event of missed lessons, you may request one-to-one education for your child, which will be charged at the going one-to-one rate.
A4.1.3 Non-attendance owing to any other reason
If your child cannot attend a lesson for any other reason (e.g., a prior engagement has overrun), you agree that you forego any claims for reimbursement of money or discount of fees from future invoices.
In the event of missed lessons, you may request one-to-one education for your child, which will be charged at the going one-to-one rate.
A4.2 Punctuality
Students should attend the lesson on time.
If your child is late to a lesson we may contact you (by phone, text or messenger) to advise you that your child is late. However, you accept that this is a courtesy and not an obligation as we cannot guarantee that it will be practical for us to contact you (e.g., if 11 Plus Prep School staff are all currently teaching).

A4.3 Leaving lessons early
Your child may not leave lessons before the lesson has officially ended. This is a child safeguarding matter.
If there is a valid reason for your child leaving the lesson early then the parent/carer accepts that they must provide at least 24 hours notice to us, explaining the reason for the student's early departure from lesson.
We shall not allow a child to leave a lesson early on the child's own say so.
A5 Cancellation of services
A5.1 Cancellation of enrolment notification period for group tuition
If you decide to cancel your child's enrolment on any of our group tuition courses, you must provide four weeks' written notice of your intention to cancel. Your child's unenrolment will begin four weeks from your written notice stating your intention to cancel your child's enrolment. You will continue to be liable for tuition fees for four weeks (equivalent to four lessons) from the date of our receipt of your notice stating your intention to cancel your child's enrolment.
A5.2 Our cancellation of your child's enrolment owing to non payment of fees
We shall inform you if we intend to cancel your child's enrolment because of non-payment of fees. If you belatedly make payment after we have cancelled your child's enrolment (i.e., deregistered your child) we shall refund your payment to you. Note that in such circumstances, we reserve the right to retain up to 10% of the payment to cover administration costs.
A6 Online lessons
A6.1 Joining online lessons
If the lesson(s) for which you have paid tuition fees is conducted online, we will send you details of how to join the lesson(s) within 24 hours of being made aware of your tuition fee payment. Online lessons are conducted by Zoom.
We shall send you the Zoom joining details via email. The email containing Zoom details shall contain the time and date of every lesson that falls within the period of time for which you have paid; it shall also contain a link with which to join a meeting, as well as a meeting ID and passcode. The link, the meeting ID and the passcode are your means of joining the lesson.
The email containing Zoom details shall also contain a link with which you may add the times/dates of the lessons to a calendar system. We recommend you add the times/dates of the lessons to your calendar so that you are unlikely to forget a lesson.
A6.2 Responsibilities for Zoom details
Once we have sent you Zoom details by email, these Zoom details shall serve as the record of when your child's lessons are taking place. It is your responsibility to record the Zoom details in the best way for you to remember them.
If you lose the Zoom details, you must contact 11 Plus Prep School immediately so that we can re-send the original email containing the Zoom details.
If you make a last-minute request for us to resend the Zoom details to you, it might not be possible for us to reply, e.g., if the lesson your child should join is already underway, or if we are teaching back-to-back lessons we might have no access to emails/phones to check your request before your child's lesson starts. To be assured of our answering your request to resend Zoom details to you, you must send the request at least 24 hours before your child's lesson is due to begin.
A6.3 Zoom details validity
Zoom details are usually valid for the entire term (with the exception of, e.g., rapid improvement courses, exam revision sessions, one-off lessons etc.). This means that the Zoom details we send you at the start of the term shall be valid until the end of the term.
If we have agreed with you that you may pay according to a schedule other than a termly schedule, your child shall be admitted to all lessons within the term for which you have paid.
Once the lessons for which you have paid have passed, you will be liable to pay for the next part of your payment schedule before the subsequent lesson (see 2. Tuition fees & payment schedule).
If payment is not made before the subsequent lesson, we may refuse your child admission to the lesson despite the Zoom details remaining valid.
A6.4 Expiry & renewal of Zoom details
The Zoom link and meeting ID & passcode shall be active for the entire duration of the period for which you have made payment. Once the final lesson of the period has been taught, the Zoom details of the period shall expire and become useless.
At this point, we have entered a new payment cycle (e.g., a new term) and renewed Zoom details will be sent upon payment of the next invoice.
It is your responsibility to remain aware that Zoom details will be renewed at the end of each term, and to use the correct Zoom details for the current term.
A7. Children with additional needs
A7.1 Notifying us of additional needs
If your child has additional needs, you must inform us of their additional needs where their additional needs have any bearing on their health and safety during lesson time or if affects their ability to learn.
A8. Study materials
A8.1. Study materials for lessons/homework
We may require that you acquire study materials for your child to use in lesson or for homework. The materials we ask you to acquire shall be the minimum number of materials that we estimate are necessary for successful participation in class and for successful completion of homework.
You agree to purchase/acquire these materials for your child.
A8.2 Purchasing/Acquisition of materials
We may, to be helpful, suggest places (i.e., online or physical bookstore) you can buy these materials. However, you accept that this is merely a suggestion, and that our suggestion does not represent our approval of the place, nor does make any guarantees about the quality of the place (e.g., its speed of service, reliability); neither do we guarantee that the place is the lowest price or represent cost-efficiency.
It is your responsibility to ensure that you are happy with the terms of service, price (etc.) of the place from which you acquire materials.
A9. Homework
A9.1 Homework schedule & medium
11 Plus Prep School sets homework. Homework will be issued by email within XX hours after the lesson. It is your responsibility to check your email account for homework from 11 Plus Prep School.
Sometimes emails from 11 Plus Prep School may go to your spam/junk folder; it is your responsibility to check your spam/junk folder for emails from 11 Plus Prep School. In our onboarding email, we shall advise you of which email address(es) to add to your email account's safe list to minimise the chances of our emails going to your spam/junk folder.
A9.2 Receipt of homework
In many cases, 11 Plus Prep School will need to see evidence that your child has completed their homework, such as for purposes of recording your child's progress, monitoring their engagement outside of class, or for marking purposes.
You agree to send homework to us (whether in the form of photographed documents, uploaded attachments or plain text) via email.
We may not acknowledge or mark any homework sent to us via another medium (e.g., WhatsApp).

The agreed schedule of payment shall be stated in an emailed invoice to you upon when you request to purchase a tuition service from us.
A10. Our commitment to tuition provision
A10.1 Alternative tutor/lesson
11 Plus Prep School has an impeccable record of delivering tuition according to schedule. You accept, however, that there may be times when, owing to illness, unforeseen circumstances or acts of God, that an 11 Plus Prep School tutor may not be able to teach a lesson at the agreed time and date.
In the unlikely event that a tutor cannot conduct a lesson at the agreed time and date, we shall endeavour to provide an alternative tutor or lesson for the lesson in question.
For example, if a tutor who is tutoring English is unable to make his commitment, we may substitute a maths tutor to provide a maths lesson. The English lesson would be provided at a later date, in place of the maths lesson.
A10.2 Rescheduling of lesson
In the event that we cannot provide an alternative tutor, we may either reschedule the lesson. If we reschedule a lesson, we would ensure that the rescheduled time/date works for all affected children and their parents/carers.
A10.2 Cancelation of lesson
If rescheduling is not an option, and we have no option but to cancel, we will discount the fees of the non-delivered lesson from your next invoice.
A11. Code of conduct
11 Plus Prep School expects that its students observe a code of conduct. Violations of this code of conduct may result in our expelling a child from 11 Plus Prep School. In the event that we expel your child from 11+ Prep School, you will be liable for fees until the end of the half-term.
A12. Unauthorised recording of lessons
Unauthorised recording of 11 Plus Prep School's lessons, whether in part or in whole, whether online or on-premise, is strictly prohibited for the following reasons:
(i) Child safeguarding: unauthorised photographic or video recording, or distribution or reproduction, of any recording, of children in our lesson is a breach of these terms and conditions and a violation to our students' (and their parents') right to privacy.
(ii) Copyright violation: 11 Plus Prep School's lessons are the intellectual property of 11 Plus Prep School. Any unauthorised recording is a violation of the intellectual property of 11 Plus Prep School.
Authorisation to record 11 Plus Prep School's lesson, whether in part or in whole, whether online or on-premise, must be sought from 11 Plus Prep School and from the appropriate authority of each child in the recording. Without this authorisation, you are in breach of 11 Plus Prep School's terms & conditions. 11 Plus Prep School will pursue legal methods to ensure that unauthorised reproductions of its lessons are not made, reproduced nor distributed.
If you record lessons without authorisation, you affirm your legal and moral obligation to permanently and irrecoverably delete the recording and any reproduction of the recording immediately. You agree that any confirmation you make to permanently and irrecoverably delete any unauthorised recording is legally binding.
B1. The 11 Plus Prep School Shop
B1.1 The 11 Plus Prep School Shop Definition
The 11 Plus Prep School shop is a "shop" or "store" (https://www.11plusprepschool.co.uk/shop) which is part of the main 11 Plus Prep School website (https://www.11plusprepschool.co.uk/)
The shop sells educational materials in either or both digital and tangible formats.
B1.1.1 Digital products definition
Digital products are intangible items that are delivered electronically.
B1.1.2 Tangible products definition
Tangible products are physical products that are delivered physically.
B1.2 The 11 Plus Prep School Shop
The 11 Plus Prep School shop is hosted by www.Wix.com. As well as hosting the 11 Plus Prep School shop, Wix acts as the payment processor for all transactions made via the 11 Plus Prep School site. B2. Your Status
When you make a purchase from 11 Plus Prep School's online shop, you are asserting that:
-you are fully authorised to make the purchase
-you are of legal age to make the purchase
-all details you provide via the 11 Plus Prep Schol shop to 11 Plus Prep School are fully accurate
-that any false or inaccurate information provided during the checkout process frees 11 Plus Prep School from any obligation to fulfil your order
-that you take all responsibility for the accuracy that you enter via our checkout procedure and that if any information is incorrect, e.g., your email address, you accept that 11 Plus Prep School is not liable for fulfilling your order and is freed from any obligation to fulfil your order.
C1 Your Purchase and Use of Digital Products
C1.1 Access to Digital Products
Upon purchasing a digital product, you will be provided with a link to access the product. The link is active for 30 days from the point of purchase. If the digital product is not redeemed within 30 days of purchase, 11 Plus Prep School makes no guarantee that you will be able to access the digital product after that period. If you do not download the product within 30 days of purchase, you agree to free 11 Plus Prep School of any obligation to deliver the product to you; furthermore, you agree that 11 Plus Prep School will not be liable to refund the cost of the digital product.
C1.2 Intellectual Property Rights and Copyrights of Digital Products
Unless otherwise stated, all digital products sold in the 11 Plus Prep School shop (https://www.11plusprepschool.co.uk/shop), 11 Plus Prep School is the copyright holder and intellectual property owner.
C1.3 Your license of Digital Products
When you buy a digital product from 11 Plus Prep School's shop, you are given a non-exclusive, non-transferrable, non-sublicensable license to download, store and use the digital product.
The quantity of your purchase of a single item is equivalent to the number of usage licenses you have for the single item.
This means that if you buy a quantity of one of an item from 11 Plus Prep School's shop, you alone have the right to use that item and you may not reassign that right to any other person, except:
-in the event that you are the parent/guardian/carer for a child, you may reassign the right to use to x1 child to whom you are parent/guardian/carer
If you buy a quantity of x2 of the same item from 11 Plus Prep School's shop, you alone have the right to use those x2 same items and you may not reassign that right to any other person, except:
-in the event that you are the parent/guardian/carer of children, you may reassign the x1 usage license to use and x1 usage license to another child, to whom you are parent/guardian/carer
In the event that you allow more usages of the item than you have licenses, you will be liable to reimburse 11 Plus Prep School for the cost of each additional license you have assumed.
C1.4 Your agreements to abide by our intellectual property rights and our copyrights
When you purchase a digital product from 11 Plus Prep School's Shop, you agree to the following:
-You will store the digital product on one device and one device only
-The one device on which you store the digital product shall be a device that you personally own
-You are permitted to make one printout of the digital item per license that you have paid for
-You will not make a copy by hand, electronically or mechanically, either in part or in whole, of any 11 Plus Prep School digital product
-You will not disseminate, circulate, send or share any 11 Plus Prep School digital product by hand, electronically or mechanically
-You will not allow 3rd party access to the digital product
-You will not make a translation, either in part or in whole, of any 11 Plus Prep School digital product
-You will not store any 11 Plus Prep School digital product, in part or in whole, in a storage retrieval system or on the Internet
C1.4.1 Violation of the agreements stated in C1.4
If you violate any of the agreements stated in C1.4, you agree that you shall destroy and delete all derivative copies made of the digital product.
You agree to indemnify 11 Plus Prep School against any liability arising from your, or a 3rd party's, unauthorised use of our digital products.
C1.5 Printing 11 Plus Prep School digital products
You may make one printout per license that you have for a digital product. When printing out an 11 Plus Prep School digital product, you agree that:
-You will make every effort to ensure that your printer is capable of printing 11 Plus Prep School's digital products
-You will not hold 11 Plus Prep School responsible for any failures or difficulties arising from your attempts to print 11 Plus Prep School's digital products
C1.6 Reliance
11 Plus Prep School's digital products are offered "as is" and may not be suitable for your purposes. For example, success or failure in an 11 Plus Prep School exam cannot be relied upon as a gauge of whether an examinee will succeed or fail at a real exam.

3.1 Intellectual property
The content of this website (https://www.11plusprepschool.co.uk/) is the intellectual property of 11 Plus Prep School. Within this website are educational materials that may be downloaded, or that we may share with you, or that may be used on the website itself. These materials are also the intellectual property of 11 Plus Prep School; such materials should not be copied, reproduced, modified, sold, or shared with anyone other than you or the child(ren) you have registered on our courses.
Form submission
Child supervision
As part of your child's education at 11 Plus Prep School, your child will use this website. You, the parent or guardian of the child, must supervise their use of this website. While on this website, your child may have access to forums, chat boards, newsgroups, emails and other communication facilities. You, the parent or guardian of the child, must ensure their correct use of this website and caution your child about entering information, including personally-identifiable information into this website.
Username & password
Upon registering on an 11 Plus Prep School course you or your child(ren) may be given a username and password to access the Members area of this website. You must not divulge your - or your child(ren)'s - username(s) and password(s) to any third-parties, or allow them use of the Member's area under your - or your child(ren)'s account.
You are responsible for maintaining confidentiality of your username and password. You are responsible for ensuring that your child(ren) do not share their username & password with any third parties, or allow them access to their account.
You agree to notify us immediately as soon as you become aware of any unauthorised use of your - or your child(ren)'s - account on this website.
You agree that 11 Plus Prep School shall not be liable for any loss or damage resulting from the diclosure of your username or password.
Sharing your - or your child(ren)'s username & password - with third parties shall be considered abuse of this website.
Warranties
We do not warrant the completeness or accuracy of the information published on our website.
